These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with pictranslate.app (the "Service") operated by PicTranslate. ("we", "our" or "us").

Please read these Terms and Conditions carefully before using our service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

 

Who can use the Service

To use our Service, you must be at least 13 years old if you reside in the United States, and 16 if you reside elsewhere. If the law where you reside requires you to be older in order for PicTranslate to lawfully provide the Service to you without parental consent (including the use of your personal data), you must be that older age.

 

Content

Our Service allows you to post, link to, store, share and make available certain information, text, graphics, videos or other materials ("Content"). You are responsible for the Content you post to the Service, including its legality, reliability and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms. You agree that this license includes the right for us to use your Content to improve our service, in particular, but not limited to, using your Content to improve and train our targeting algorithms.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contractual rights or any other rights of any person.

 

Your responsibilities

PicTranslate may verify that your conduct and content comply with these Terms. We are not responsible for content posted and shared through the Services.

 

Accounts:

When you create an account with us, you must provide us with information that is accurate, complete and up to date at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for protecting the password you use to access the Service and for any activity or action under your password, whether your password with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity, or which is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without authorization or a name that is otherwise offensive, vulgar or obscene.

 

Signatures

Subscriptions are charged monthly or annually by credit card (We use Stripe as a partner company to securely charge this for you). At the end of each month or year, as you choose, the subscription will automatically renew each month or year unless turned off at least 24 hours before the end of the current period. To stop automatic renewal, please contact us to request cancellation of your subscription.

 

Termination

You can stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services, upon notice, if:

- you are violating these Terms,
- your use of the Services could cause a real risk of harm or harm to us or other users, or
- you do not have a Paid Account and have not accessed our Services for 12 consecutive months.

We will send reasonable advance notice to the email address associated with your account so that you can correct the activity that caused us to contact you and to give you the opportunity to export your Files from our Services. If, after such notice, you fail to take the requested action, we will terminate or suspend your access to the Services.

We will not provide notice or an opportunity to export your files prior to terminating or suspending access to the Services when:

- you are in absolute breach of these Terms,
- doing so would give rise to legal liability or compromise our ability to provide the Services to other users, or
- we are prohibited by law from doing so.

 

Disruption of Services

We may decide to discontinue Services in response to unforeseen exceptional circumstances, events beyond PicTranslate's control (eg natural disaster, fire or explosion) or to meet legal requirements. If this happens, we will provide you with reasonable notice so that you can export your files from our systems (where possible, we will provide at least 30 days' notice). In the event that we discontinue the Services in this manner before any minimum or fixed term for which you have paid in advance, we will pro-rata reimburse you for the Services fees paid for but not received.

 

Respecting the rights of others

PicTranslate respects the rights of others. And so should you. For that reason, you may not use the Services or allow anyone else to use the Services in a way that:

- Violates or infringes on anyone's rights of publicity, privacy, copyright, trademark or other intellectual property rights;
- Threaten, harass or intimidate;
- Defamation;
- Spam or solicit our users.
- Research/development of artificial intelligence (in particular generation of training data).

You must also respect PicTranslate's rights. These Terms do not grant you any rights to do the following (or allow anyone else to do so):

- use brands, logos, designs, photographs, videos or any other material used in our Services;
- copy, archive, download, upload, distribute, syndicate, transmit, display, make available or otherwise use any part of the Services or the content of the Services, except as authorized in these Terms;
- use the Services, any tools provided by the Services, or any content on the Services for commercial purposes without our consent.

 

Security

Safety is a priority for us. While we do our best to keep our services secure for all users, we cannot guarantee this. That's where you come in. By using the Services, you agree to:

- Not to use the services for any purpose illegal or prohibited by the Terms.
- Not use any robot, spider, crawler, scraper or other automated tool or interface to access the Services or extract information from other users.
- Do not use or develop third-party applications that interact with the Services or other users' content or information without our written permission.
- Not to use the services in a way that could interfere, interrupt, negatively affect or inhibit other users from fully enjoying the services or that could damage, disable, overload or compromise the functioning of the services.
- Do not use or attempt to use another user's account, username or password without their permission.
- Do not request login credentials from another user.
- Do not post content that contains or references pornography, graphic violence, threats, hate speech or incitement to violence.
- Not upload viruses or other malicious code or otherwise compromise the security of the Services.
- Do not attempt to circumvent content filtering techniques we use or attempt to access areas or features of the Services that you are not authorized to access.
- Not scan, verify or test the vulnerability of our services or any system or network.
- Not encourage or promote any activity that violates these Terms.

We care about your security when using our services. Therefore, please do not use our services in a way that might distract you from obeying traffic or safety laws. Never put yourself or others at risk just to capture a video.

 

Intellectual Property

The Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of PicTranslate. The Service is protected by copyright, trademark and other laws of both Brazil and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PicTranslate.

 

Links to other websites

Our Service may contain links to third party websites or services that are not owned or controlled by PicTranslate.

PicTranslate has no control over and assumes no responsibility for the content, privacy policies or practices of any third-party website or service. Furthermore, you acknowledge and agree that PicTranslate shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through such websites or services.

We strongly recommend that you read the terms and conditions and privacy policies of any third-party website or service you visit.

 

Closing

We may terminate or suspend your account immediately, without notice or liability, for any reason, including, without limitation, if you violate the Terms.

Upon termination, your permission to use the Service will immediately cease. If you wish to terminate your account, simply stop using the Service.

 

Limitation of Liability:

In no event shall PicTranslate or its directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, use, good will or other intangible losses arising out of (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content by any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, even if we have been advised of the possibility of such damage

Warning

Use of the Service is at your own risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance of course.

PicTranslate does not guarantee that:

a) the Service will be uninterrupted, secure or available at any specific time or location;

b) any errors or defects will be corrected;

c) the Service is free of viruses or other harmful components;

d) the results of using the Service will meet your needs.

 

Legality

These terms will be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding our Service and supersede and supersede any prior agreements we may have between us regarding the Service.

 

Changes

We reserve the right, in our sole discretion, to modify or replace these Terms at any time.

If a revision is material, we will attempt to provide at least 30 days notice before any new terms take effect.

What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after these revisions become effective, you agree to be bound by the revised terms.

If you do not agree to the new terms, please stop using the Service.
